Virginia security deposit itemization

What Virginia requires
- Deadline
- 45 days after the tenancy ends or the tenant vacates, whichever is later. If damage exceeds the deposit and needs a third-party contractor, written notice within the 45 days gives 15 more days to itemize.
- Delivery
- Written notice to the tenant; electronic notice if the tenant agreed to it.
- If it is late
- Wilful failure: the court orders the deposit returned, plus actual damages and attorney's fees.
- Condition record
- A written report of existing damage within five days of occupancy.

- Keep the records behind every deduction for two years and let the tenant inspect them. Within five days of the tenant's notice to vacate, tell them in writing of the right to attend the move-out inspection, held within 72 hours of possession being returned.

What goes on the statement
The deposit and the date it was received, each deduction with a specific description and amount, the total withheld, and the refund or balance owed. Virginia landlords also record how and when the statement was sent, because the deadline is measured to that date. Damage lines should say what was damaged and how, not just a room name: a tenant, and a judge, can tell a burn mark from carpet wear.
Interest, a separate deposit account, receipts, photographs and a sworn attestation are only required in some states. The generator shows the fields Virginia needs and leaves out the ones it does not.
