What Delaware requires
- Deadline
- 20 days after the rental agreement ends or expires. A tenant who gave no forwarding address in writing at or before termination is owed no notice and no penalty, but can claim the unused deposit for a year.
- Delivery
- Send the list and payment to the address in the rental agreement or to a forwarding address the tenant gave in writing at or before termination.
- If it is late
- No timely list is an acknowledgment that no damages are due; a late refund costs double the amount wrongfully withheld.
- Deposit account
- The deposit sits in an escrow account at a federally insured bank with a Delaware office; failing to use one, or to disclose it within 20 days of a written request, forfeits the deposit.

What goes on the statement
The deposit and the date it was received, each deduction with a specific description and amount, the total withheld, and the refund or balance owed. Delaware landlords also record how and when the statement was sent, because the deadline is measured to that date. Damage lines should say what was damaged and how, not just a room name: a tenant, and a judge, can tell a burn mark from carpet wear.
Interest, a separate deposit account, receipts, photographs and a sworn attestation are only required in some states. The generator shows the fields Delaware needs and leaves out the ones it does not.
