What Maryland requires
- Deadline
- 45 days after the tenancy ends; for an evicted or abandoning tenant, 45 days after the tenant's written demand.
- Delivery
- First-class mail to the tenant's last known address.
- If it is late
- The forfeiture is of damage deductions; unpaid rent may still come off. Withholding without a reasonable basis costs up to three times the amount withheld plus attorney's fees.
- Documentation
- Supporting documentation identifying the materials or services for each item. An estimate is allowed if you send the final invoice when the repairs are done and refund any excess within 30 days.
- Condition record
- If the tenant asks by certified mail within 15 days of moving in, inspect with them and give a written list of existing damage.
- Deposit account
- Within 30 days, in an interest-bearing account used only for security deposits at a Maryland branch of a federally insured institution (or in insured CDs or U.S. or Maryland securities).
- Interest
- Simple interest at the greater of the one-year Treasury rate on the first business day of the year or 1.5%, accruing monthly from the day the deposit was paid, on deposits of $50 or more held at least six months.
- Also
- If the tenant gives 15 days' certified-mail notice of moving out with a new address, notify them by certified mail of the inspection date and inspect within 5 days of move-out; the tenant must have been told of this right in writing when the deposit was paid. Skipping it forfeits the right to withhold for damage.

What goes on the statement
The deposit and the date it was received, each deduction with a specific description and amount, the total withheld, and the refund or balance owed. Maryland landlords also record how and when the statement was sent, because the deadline is measured to that date. Damage lines should say what was damaged and how, not just a room name: a tenant, and a judge, can tell a burn mark from carpet wear.
Interest, a separate deposit account, receipts, photographs and a sworn attestation are only required in some states. The generator shows the fields Maryland needs and leaves out the ones it does not.
