Georgia security deposit itemization

What Georgia requires
- Deadline
- 30 days after you obtain possession; a 30th day on a weekend or legal holiday moves to the next business day.
- Delivery
- Mail to the tenant's last known address.
- If it is late
- A late list forfeits the right to withhold any of the deposit or to sue for damage. Improper withholding costs three times the sum withheld plus attorney's fees, or only the sum if you show an unintentional bona fide error despite reasonable procedures.
- Condition record
- A move-in inspection list and a move-out list (within three business days of move-out) are conditions of deducting for damage, on the stricter reading of § 44-7-35(a).
- Deposit account
- An escrow account used only for deposits at a regulated bank or lending institution (or a surety bond), and the tenant is told in writing where it is; without it you cannot keep any of the deposit.

- An individual owner of ten or fewer units who manages them without an agent is exempt from the lists, the escrow and the forfeiture.

What goes on the statement
The deposit and the date it was received, each deduction with a specific description and amount, the total withheld, and the refund or balance owed. Georgia landlords also record how and when the statement was sent, because the deadline is measured to that date. Damage lines should say what was damaged and how, not just a room name: a tenant, and a judge, can tell a burn mark from carpet wear.
Interest, a separate deposit account, receipts, photographs and a sworn attestation are only required in some states. The generator shows the fields Georgia needs and leaves out the ones it does not.
